  • Do I need to pay anything up front to file for Social Security Disability, or appeal for a Social Security denial? 

    • No. You do not need to pay up front.   If you win, I will typically be paid directly by Social Security out of the money they owe you.   

 

  • When should I hire an attorney for a Social Security case?  

    • Typically, people contact a lawyer to help after they are denied in writing and informed by Social Security that they will need a hearing with an Administrative Law Judge (ALJ).  There is a limited time to appeal the denial, so quick action is often warranted.  However, you can obtain a lawyer to help at any point in the process, even to file the initial application.

  • How do you get paid in estate planning cases? 

    • ​can either charge by the hour or create a custom package for a fixed price to fit your budget, whichever suits your needs best.  
       

  • What is the difference between an advanced directive and a healthcare Power of Attorney? 

    • ​At the most basic level, an Advanced Directive tells health care providers what you would like to happen in the event of your incapacitation.  A Healthcare Power of Attorney gives a trusted person the ability to make important health care decisions for you in the event of your incapacitation. 
       

  • What does a will do? 

    • A will is one of the first steps people think of when thinking about estate planning.  It is simply a legal document that names who will receive your property when you die.   
       

  • What is probate?

    • Unless exempt, all property left by a will must go through a process called probate.  This is a court process that can be formal or informal and essentially pays the estate debts, takes care of taxes, and distributes estate property.  
       

  • What does a trust do?  

    • Basically, a trust is a flexible estate planning instrument that can be formed many ways.  Essentially, it allows you to leave property to your loved ones in a way that suits your needs/desires.  It is more private than a will and can often avoids probate.  A trust can be created while you are living or at your death.  
       

  • What is a special needs trust? 

    • A Special Needs Trust is an instrument that can help care for your loved one with special needs.  It is generally irrevocable once created but can be set up to help care for their needs beyond their daily living expenses.   
       

  • Does it cost anything for a consultation? 

    • No.  Calling us does not cost you.  In our first meeting, we will get to know you and create a clearly customized plan to meet your needs and budget.  This will clearly be set out at the initial consultation.
